It's a decent piece overall, I agree. Unfortunately, he repeats one of Ari Armstrong's sillier arguments, namely that Amendment 36 is an "ex post facto" law. Unless that phrase means something radically different in Colorado than it means everywhere else, only criminal laws can be ex post facto.

Good point--although, like you, I think the overall argument against the amendment is strong.

I was just talking to one of my friends (a died in the wool lefty) who plans to vote for 36, though. I asked her why she didn't like the idea of pushing it forward in a more populous state like California. She got a twinkle in her eye and grinned, "Because we have that state all sewn up."
