resurrectionsongMarch 04, 2004Walter v/ Eminent DomainWalter tackles eminent domain today, spurred on by a Colorado Supreme Court decision that could be seen as a victory for the people on my side of the debate. I'm not so sure that it was a win; it might have merely been a set of instructions for creating another set of rules for condemning land that would clear legal hurdles in the future. I'll let brighter minds than mine decide on the overall good or bad of the ruling, and simply be happy that the entire conversation seems to be going in a direction that will be better for property owners in the long run. In the article that Walter points to it's noted that Colorado legislators are working to tighten up the circumstances in which condemnation can be used, mostly aiming at stopping the very corporate subsidies to companies like Wal-Mart that Walter is discussing while leaving room to condemn "truly" blighted land. Of course, there is always a danger in leaving loopholes for the government. They have a way of using them in ways that you never would have imagined.
