resurrectionsongJuly 14, 2003Nevada Court Strikes a Blow for Crippling Economic PoliciesThe message that the Nevada court is sending to voters today is that the voters mean nothing. Nevada voters had enacted a state law that required a super-majority (2/3rds majority) vote of the state legislature to approve any increase in taxes. The Nevada Supreme Court sidestepped that by suspending the law (not declaring it unconstitutional) when the legislature fails to enact tax increases to fund the education budget. So the Nevada voters are basically being told that they can vote for whatever laws they want, and those laws may be entirely constitutionally acceptable, but that the state government can still do whatever the hell they want. This is an ugly day for the Nevada Supreme Court, and an ugly day for voters in Nevada. Even worse, other states with restrictive tax laws (like ours in Colorado) may try the same stunt with their own courts.
